These Terms of Service (“Terms”) apply to your use of the CareTrack website and software operated by CareTrack Oy. By creating an account or using the service, you agree to these Terms and our Privacy Policy.
1. The service
CareTrack provides cloud software for social service organizations to manage cases, communications, family portals, documents, and related workflows. Features vary by subscription plan. We may update the service to improve security, compliance, or functionality.
2. Accounts and acceptable use
You must provide accurate registration information and keep credentials confidential. You are responsible for activity under your account. You agree not to misuse the service, attempt unauthorized access, upload unlawful content, or process personal data without a valid lawful basis as required by GDPR and Finnish law.
3. Customer data and GDPR
Organizations using CareTrack for casework remain responsible as data controllers for family and staff data they enter. CareTrack processes that data as processor under applicable data processing terms. Each party will comply with GDPR, the Finnish Data Protection Act, and professional secrecy obligations relevant to social care.
4. Availability and support
We strive for high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated when practicable. Support channels are described on our website and in your organization settings.
5. Liability
To the extent permitted by mandatory Finnish and EU consumer or contract law, our liability is limited to direct damages caused by intentional misconduct or gross negligence, and otherwise capped as set out in your commercial agreement. Nothing in these Terms limits liability that cannot be limited by law.
6. Termination
You may stop using the service according to your plan. We may suspend access for material breach or legal requirement. Upon termination, export and deletion of data follow the Privacy Policy, your DPA, and applicable retention law.
7. Governing law
These Terms are governed by the laws of Finland, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of Finland, unless mandatory consumer protection rules provide otherwise.
